SKIMS Retail LLC, the multi-billion-dollar shapewear brand co-founded by Kim Kardashian, is facing a wage-and-hour class action lawsuit. The case provides a cautionary tale for companies who fail to scale their compliance review along with their business, and serves as a reminder to employers that investing in compliance measures now could spare them a much bigger legal and financial headache down the road.

A Pennsylvania federal jury has awarded Penn State University $28,000 in damages over a trademark dispute against Vintage Brand LLC, finding that the online retailer willfully violated the school’s trademarks by selling merchandise featuring Penn State’s vintage logos. Although this was not the first trademark case over collegiate merchandise, and a dozen or more other schools -- including UCLA, Stanford, and Purdue -- have sued Vintage over similar trademark violation claims, this case was the first to go to a jury. Despite the relatively low damages and the fact that the verdict isn't binding precedent, the outcome of the case may have a huge impact on future licensing deals, and will serve as a strong deterrent to other businesses selling sports merchandise without authorization.
