Trust Decanting

The Uniform Trust Decanting Act, effective January 1, 2019, changes the California Probate Code to allow fiduciaries to "decant" irrevocable trusts, that is, to modify the terms of an irrevocable trust without the consent of the beneficiaries or approval of the court, subject to certain exceptions.
