August 2016 Update

Effective January 1, 2016, a revocable transfer on death deed (revocable TOD deed) may be used to (a) make a donative transfer of certain real property to a named beneficiary (b) that operates on the transferor's death and (c) is revocable until the transferor's death. Prob C §5614(a). The revocable TOD deed may have been executed or recorded before January 1, 2016, but is effective to transfer title only if the transferor died after that date. Prob C §5600. See new sections and forms in §§4.12B–4.12I. See also §§1.6, 4.18, 6.2.

California Rules of Court govern the format of probate documents. "Papers" include documents in electronic form, unless the context clearly provides otherwise. Cal Rules of Ct 2.3(2). Any California Rules of Court requirements specifying paper quality/color or typewritten/printed pages does not apply to electronically filed papers. Cal Rules of Ct 2.103–2.104. See §1.18.

The court can electronically serve any notice, order, judgment, or other court document in the same manner that parties can serve documents by electronic service. See Cal Rules of Ct 2.251(j)(1). See §5.14B.

Besides the National Death Index (NDI), there is an additional way to access death record information. The Social Security Death Index (SSDI) is accessible through various websites, including http://www.deathindexes.com/ssdi.html. See §2.6.

Probate Code §§5600–5604, regarding passing property to former spouses or domestic partners, have been renumbered as Prob C §§5040–5044. See §4.3A.

As of January 1, 2016, Cal Rules of Ct 7.802 applies the provisions of CCP §1010.6 and Cal Rules of Ct 2.250–2.261 to contested proceedings under the Probate Code and Probate Rules. See §5.14B. The filing fee is $40 for a request for special notice under Prob C §§1250, 2700, and 17204. Govt C §70662. See §5.24.

The custodian of the will must, within 30 days after having knowledge of the death of the testator, deliver the original to the county clerk of the county in which the estate of the decedent may be administered. Prob C §8200(a). The fee for delivering the will to the clerk is $50. Govt C §70626(d); Prob C §8200(d). See §7.7.

Although a nonresident of the United States may not act as representative unless he or she is named as executor or successor executor in a will, the nonresident can nominate a U.S. resident to be appointed as administrator when there is an intestate estate. Prob C §8465(a)(2). See §7.8B.

The California Probate Referees' Association has revised The Probate Referee Guide: Using Probate Referees in Trusts, Probate, Conservatorships and Guardianships, Small Estates and Non-Probate Matters (2015). See chap 11.

A certification by the translator must accompany both the original language version and the English translation of any document or pleading. See Cal Rules of Ct 3.1110(g). The Judicial Council provides a Master List to search for certified and registered interpreters. See §20.8.
