Aims
and Content
This guide brings together in one place both applicable federal
law and the broad spectrum of California statutes and regulations
that affect representation of elders. The coverage reflects major
concerns of the elderly and their families as they confront the
impacts of declining health and diminished capacity on their autonomy,
health care options, management and preservation of their property,
and vulnerability to abuse. Analysis of applicable law is supplemented
by practice aids, including guides to procedures and analysis of
planning strategies based on real life hypotheticals.
State and federal resources and benefits that might enable an elder
to remain living in his or her own home are summarized. The authors
present a clear explanation of the complex and always changing Medicare
and Medi-Cal rules, and then present hypotheticals and examples
from practice that show what planning opportunities exist within
the statutory framework. Forms are also provided, including attorney-drafted
documents and pleadings, and other court papers.
